Sales Terms

No order for goods shall be binding upon the seller unless and until, and to the extent, accepted by the seller in writing The terms and conditions contained herein shall prevail over any statements, clauses or conditions on the order form which purport to modify, add to or are inconsistent with the terms of these conditions of sale, unless specifically agreed otherwise in writing by the seller.

Payment for the goods becomes due upon acceptance of the order by the seller and the goods ordered will only be despatched for delivery once payment has been received.

Delivery shall be made by courier, who shall act as an agent on behalf of the purchaser. The purchaser shall be responsible for the delivery costs and all risks in respect of the goods shall pass to the purchaser upon delivery of the goods to the courier or transport company concerned.

The seller shall not be liable for any loss, liability, damage (whether direct, indirect or consequential and whether or not in the contemplation of the parties), costs or expenses of whatsoever nature or howsoever arising which are attributable to the goods and /or the supply (or failure to supply, as the case may be) of the goods and the purchaser indemnifies the seller against all loss liability damage (whether direct, indirect or consequential and whether or not in the contemplation of the parties) or expense of whatsoever nature or howsoever arising which is attributable, whether directly or indirectly, to the goods and /or the supply (or non- supply as the case may be) of the goods.

If within a two year period commencing on the date of the order, the goods are found to be faulty during normal use, then the seller will in its discretion repair or replace the defective goods. In either case the purchaser shall be obliged to deliver the goods to the seller’s premises for this purpose and shall be responsible for the costs of delivery of the new/repaired goods.

The sale of the goods and the conditions contained herein shall be interpreted and governed in all respects by the laws of the Republic of South Africa. The purchaser hereby consents to the non-exclusive jurisdiction of the following courts in relation to any legal proceedings instituted in connection with the sale of the goods- The Cape of Good Hope Provincial Division of the High Court of South Africa (or its successor in title); and the courts of the country in which it is alleged that any breach of the provisions of this agreement have occurred.
